The future of Cosmetic Claims – Animal Testing Claims

Since the implementation of the European Cosmetic Regulation 1223/2009 cosmetic products in the EU have been able to make ‘Cruelty Free’ claims on their packaging. This was allowable under specific guidance in the regulation. In fact, several 3rd party organisations have offered certification to high levels of ‘Cruelty Free compliance’.

However, this has changed in recent months in the EU with several member states taking action against these claims as they contravene ‘Legality’ requirement of the EU claims common criteria. Namely that you should not claim to do something you have to do by law.

As such, the removal of claims such as ‘Cruelty Free’ should be carried out.

If you use a 3rd party certification service such as those provided by PETA or Cruelty Free International, you should contact your account manager. Many of these services have updated their logos to meet new EU requirements and these should be used going forward.
